NIAOA All India body filed an affidevit before the Honourable Court of Judicature at Madras challenging the Para 2.2 and Para 2.3 of the the terms and conditions of Checkoff Circular dt.31-07-2009.NIAOA sought an order of injunction restraining the New India Management from anyway giving effect to Paras 2.2 & 2.3 of said Checkoff Circular. NIAOA also pleaded to grant an order of injunction restraining the New India Management from in anyway declining to deduct the subscription of NIAOA from the salary and remit the same to the Association as it has been done from the year 2004. The writ is expected to be heard tomorrow i.e, 12-08-2009. Meanwhile , we understand GIPSA companies are planning to tempororily defer the Checkoff excercise pending discussions with the Unions/ Associations. We will keep you informed of developments.

Sir, Re: BCG’s initiatives vis-à-vis dislocating of OfficesWe note that as one of the BCG’s initiatives, you are setting up claims hub in different Regional centers. We also see a pattern, in setting up these hubs, in as much as that the existing Division/Branch offices are evicted in lock, stock and barrel to far off centers to accommodate the claims hub. No prudent corporate would dislocate its marketing unit from its established place to far off place to accommodate back office function like claim processing which can be easily located anywhere. This action of New India management is totally devoid of logic and dangerous and we hope management would immediately reconsider and stop eviction activity.It has been brought to our notice very recently in one of the Divisional Offices (DO 712700) in Chennai with a premium of around Rs.10 crores and with an established clientele base in midst of business center in Chennai has been asked to vacate and look for office premises in the suburb. This will erode the client base and affect the economics of the Division. Moreover, we have already demanded in the last BCG meeting that the Operating offices should not be merged/closed/relocated in the name of re-engineering process. Hence, we urge upon you to advise Chennai RO management to desist from the idea of relocating the Divisional Office and instead find a suitable alternative accommodation for claims hub. The New India management is moving heaven and earth to make BCG’s initiatives succeed. To ensure such success you are dismantling the existing structure and breaking the hierarchy. In this process we also witness some of our over ambitious executives show their exaggerated loyalty to BCG than to New India. If New India management has shown the same vigor and steel in implementing its own decisions in the past and improved the discipline in the industry, the New India would have achieved much greater heights than BCG’s Project Energy could achieve.
